Agk2 lar klu ye pon ko nk jhnm xkn cpt sgt..
Sudahnye, nk kejar mase aku tggl je dlu kete 2 gi keje nek teksi. Mmmg terbaik lar naik cab dr Puchong smpi Jln Duta. Jam hbt x pyh cite tp Alhamdulillah made it in Court b4 9.00 am (i.e before case start). Taxi fare kne RM30.00 lps diskaun bbrp sen. Tp baik abg taxi 2..dlm taxi bukak lagu maher zain je..tenang hati dgr.. :)
Lps hbs kes blk opis nek kete BMW boss..wow~haha..pulak 2 bos ngan driver die (a.k.a despatch ofis kitorg gak) duk dpn..aku duk blkg.. (erk..sape yg bos nih?) Macih bos bg tmpg kete..siap bg aku amik half day lg gi repair kete..
Makanye b'sinar2 lar hr aku amik half day kn. Tp pening kpla lak ptg nk kne kuar duit repair kete. Tp lps check2 rupenye mmg bateri kong bkn starter. Hantu punye workshop. Bateri cikai ape ko bg kt aku bru 6 bln pki dh mampos. Sabo jela..nsib baik dpt tkr bateri bru free sbb under warranty. Kalau x naik hantu gak aku bln2 puase nih. Makanye Cik Viva aku dh sht..sian die..asik sakit je..Cik Viva sakit lg byk pki duit dr aku sakit..

Kek Batik Tradisional
Pagi2 my hubby dah buat request nk makan kek batik..so tgh hr kuar pegi Jusco, IOI Mall and petang mule m'baking. Mlm hasilnye pon siap!
Kek paling senang nk buat. sesuai utk org2 yg malas, x pandai masak, nk cepat gemok dsb. haha~sume tu ade pd diri aku.. ;P
Okay, the ingredients are (utk 4-5 org mkn/ +/- 2 tupperware medium size kot):-
1) 200gm serbuk milo (bkn air milo)
2) 1/2 tin susu cair
3) 1 buku butter (250gm) kalau pki unsalted butter lbh sdp
4) 1 pek bismut marie.
5) sedikit perisa coklat/esen vanila utk tmbh bau
6) hirisan almond yang dipanggang sekejap je (utk hiasan).
4) Bile semua bahan dh sebati, masukkan sedikit perisa coklat/esen vanila. Gaul sebati.
7) Akhir sekali taburkan hirisan almond yang dipanggang sikit td (supaya rangup) atas kek supaya xde lar HITAM je kek tuh..hehe~
8) Ok blm siap lagi rupenye..masukkan dalam fridge dlm 4 jam supaya kek btul2 keras dan x melekit.

1) Patahkan biskut marie mengikut size yg korang suke. tp jgn lar kcik sgt sbb nnt bile gaul dgn bhn lain hancur pulak. seeloknya kerat 4 je..
2) Panaskan kuali besar (senang nak gaul sume bhn2). Bile dah panas masukkan sume butter td. Gaul sampai cair ye.
3) Bile sume butter dah cair, masukkan sume serbuk milo td. Nak masukkan sikit2 pon boleh jugak. Make sure x b'ketul2 ye. (Fai'e wat pon ade gak ketul sikit2..)
4) Bile semua bahan dh sebati, masukkan sedikit perisa coklat/esen vanila. Gaul sebati.
5) Then, masukkan biskut td sikit2 dan gaulkan. Jangan masukkan biskut skali sume. Tgk kepekatan & kelikatan coklat tu bile masukkan biskut. Ikut kesusaian dan selera masing2.
6) Make sure coklat tuh jgn ngam2 je utk biskut. Make sure ade lebihan sikit supaya mase penyekkan biskut dalam loyang/bekas ade lebihan coklat yang akan ratakan bhgn2 biskut tu..(erm ok korang faham ke ape aku ckp..?) hah suke hati lar korang nk ltk cane pon. fai'e nye jadi mcm ni-
7) Akhir sekali taburkan hirisan almond yang dipanggang sikit td (supaya rangup) atas kek supaya xde lar HITAM je kek tuh..hehe~
8) Ok blm siap lagi rupenye..masukkan dalam fridge dlm 4 jam supaya kek btul2 keras dan x melekit.
Tapi kalau korang x penyabar mcm fai'e..x cukup 4 jam dh potong, hasilnye mcm ni. Coklat x keras btul lg. Tp hasilnye tetap mantap! (p/s: kek yang dipotong yg xde hirisan almond kt atas sbb my bro x suke almond..)

Galaxy Note buat hal lagi!
Oh yeah..semalam mungkin nyaris2 hp meletop dkt kepala aku sbb??? Balik keje aku charge hp. Ltk dkt kpla katil. Then tetido..ade lar dlm 2 jam lps tuh aku t'jage hp 2 panas nk mati mmg aku rse lame lg ckit bole meletop! *siyes panas gile* tp aku tgk bateri x gerak. still mcm b4 charge less than 10% tp hp and battery panas mcm 2 apsal???
aku dgn takutnye (smbl bace2 doa) cabut charger and battery hp..(doa kot2 hp meletop mase aku pgg). Bodo kan samsung nih? Apple nk buat hp harge ribu riban ko pun nk buat..tp ko punye kualiti klh Cokia 3310!
Aku try2 google masalah bongok ni kt tenet rupenye rmi mengalami mslh yg same! Hah trimas lar samsung. Kalau aku jumpe CEO ke sape2 pgkt atas samsung tu mau aku pelangkong kpla diorg 3-4 kali.

Things to Hate About Samsung Galaxy Note!
Grrrrr!!! Dah macam beruang lapar dh aku nih.
Yeah I'm terribly mad with samsung galaxy note performance and the whole of Samsung company! I'm galaxy note user since 1.1.2012. At first when I bought it, it was fine - always! But each new software update will give me headache and heartache (?)!
It's totally not worth it for RM2,300.00 for this kinda performance and quality!!!
Among the stoooooooopid (maknenye bodoh sgt lar tuh..) problems are:-
1) Videos keep missing from folder, no matter recorded video @ movies that I saved in the hp. Sometime all the vids just went missing. So I lost all my previous vids that I've recorded but didnt have the time to save for backup.
2) After latest software update 4.0.3 (right?), the screen sometime suddenly gone like screen of broken computer (the old way) or maybe old TV (mcm TV lame bile rosak sebelum kuar muke hantu kan? OK ape aku merepek).

it looks something like this. but without the tear part. just the lines. it's so damn frustrating coz it looks like my hp is broken!
3) After latest software update, the battery consumption is damn ridiculous. I have to charge my hp twice a day (even without playing games for more than half an hour). Before the last update I only needed to charge my hp once a day. Note: this is even when I've installed battery saver etc.
4) Before the last update, my hp would suddenly went off automatically. Sometime it happened few times a day. After the last update, the damn thing will restart automatically whenever it feels like doing so. WTH? It also happens few times a day!
5) The network (I'm a celcom user) just wont turn on. I dont think it's a network problem coz all I need to do is just to restart the hp then the network will be fine. Dah lar aku xde keje nk on/off hp tuh.
6) It's difficult to turn on the hp. Not enough with pressing the right side bar once. Need to click it for few secs and for few attempts. Lembap utk on faham x?
So, kadang2 memang ade fefeling nk campak je hp tu. Tp ibarat campak wang tunai RM2,300.00 dalam gaung! So x jadi campak.
I know i'm not the ONLY person complaining about these damn problems! Ramai org yg dh complain tp samsung memang lembap amik action. Ko nk terkubur mcm blackberry and cokia ke thn dpn?!

yeah~Norman was going to Pulau Redang last nite with his besties (i'm sure this is not the word that guys use)..leaving me behind in KL..the feeling is sucks! haha..memang x suke kalau kne tinggal dgn die.. ;( but he said dis one is considered like a bachelor party for him coz this gonna his last holiday with frens before we get married next year..
so before he left yesterday we went out for few hours. sempat lar had a lunch at Johnny's, watched movie Ice Age 4 (damn hilarious okay!) and went to buy a wedding gift for Kamilah and Johari's wedding today.

another restaurant kitorang suke pegi seoul garden..siap dh buat membership..tp xle lar nk gi slalu coz mhl wooo buffet die..lunch for 2 paxs around RM75.00 (without discount for members). tp kalau makan c2 mmg dalam 3 jam lar bg max punye mkn..hehe~ :D
erm..bile nk pegi Royale Chulan ni coz Norman ade kupon makan kt Royale Chulan Hotel worth RM170.00..to be honest kitorg mmg xde lar nk makan kt hotel saje2 except ade function. So xsure lar cane nk mkn kt hotel nih ek..haha..ape punye soklan lar..nnt lar kalau berjaye pegi amik gmbr. Tp rugi lar kalau xpegi..expiry kupon tu 31/8/2012. means kne lar pegi b4 puase..hurm..kne cr mase nih..

Die ckp sbb kek tu nk bwk blk umah bg my family mkn..die segan nk tulis ade syg2. takut my dad mrh sbb my dad mmg xsuke public affection nih..hehe~

Landlord & Tenant
This post will ONLY covers a landlord's right to recover vacant possession of demised premise from a tenant in Malaysia.
Situation:-
Tenant reluctant to vacate premise (in terms of physical occupation/tenant's belongings/chattels remain in the premise) after:-
1) tenancy agreement terminated;
2) tenancy agreement ended;
3) breach of contract (which leads to termination of tenancy agreement);
4) etc (must be lawful reasons that the premise is to be returned to the landlord).
First of all, tenancy agreement may exists from verbal agreement and/or written agreement. It's a common practice here in Malaysia that the tenancy agreement is based on a verbal agreement between both parties.
With regard to written tenancy agreement, it is also common that there is/are "self-help" provision(s) which gives right to the landlord, among others, for the followings:-
1) to re-enter premise upon 14 days (or any other no. of days specified) from the date the tenancy agreement terminated;
2) to deal with the tenant's belongings left inside the premise in a specified manner e.g. to dispose off, to place it outside the premise, to take it etc (all kind of actions beside seizure and sale under the Distress Act 1951.
3) to cut off water/electricity;
4) to lock up premise from being entered by the tenant.
All the above actions are considered to be taken by the landlord in order to take back vacant possession from the tenant (who may come from hell).
The legal issue is: whether such provisions are enforceable under the Malaysian law?
There are 2 ways to recover vacant possession that are thru self-help method or thru an action in Court. Landlord tends to choose by way of self-help method as it will save costs and time and money. Contoh2 self-help methods ni mcm kt atas tu lar. Means any action yang landlord ambil atas inisiatif sendiri. Cth lain: menggunakan kekerasan yg munasabah utk halau tenant, tukar kunci pagar, potong air/elektrik. Name pon self-help kan. Tak semua org nk pegi selesaikan semua benda dkt mahkamah. Nak lantik lawyer lar pong-pang-pong-pang plg kurang dh kne RM5,000.00 xpasal2.
As such, provisions of that kind are known as "self-help". This concept/principle/doctrine of self-help derives from common law which "refers to individuals' implementation of their rights without resorting to legal writ or consultation of higher authority".
The other way is through Court action which is provided in s. 7 of the Specific Relief Act 1950 ("the SRA") - Recovering Possession of Property - Immovable Property.
Section 7 of the SRA states that:-

(3) In subsection (2) "occupier" means any person lawfully in occupation of the property or part thereof at the termination of the tenancy." |
Pre-1992 (before amendment is made to s. 7 of the SRA)
1) Trustees
of Leong San Thong [1987] 2 MLJ 511 – s.
7 and 8 of SRA did not exclude the remedy of self-help. These provisions were
only enabling provisions which may be resorted to if the landlord chose to
proceed by an action in court.
Post
amendment to s. 7(2) of the SRA in 1992.
2) Dr.
Harjit Singh v. Suhaimi Samat [1995] 1 LNS 62 – the landlord locked
out the tenant out of premise. The action amounted to a breach in tort and
against s. 7(2) SRA as the landlord did not obtain court order to recover the
premise.
3) Er
Eng Bong [2001] 1 CLJ 289 – the
amended s. 7(2) of SRA “would relegate the remedy of self-help into oblivion” as
the landlord can only seek to enforce his right to recover his property by way
of an action in court.
4)
Nur
Islam Worldwide Industries Sdn Bhd [2001] 7 CLJ 494 – landlord terminated TA
due to default of payment of rental by tenant. Landlord then went on to recover
the premise and sealed it off from the tenant. The Court held that:-

“Saya
mendapati tindakan pihak defendan (landlord) memasuki dan menutup premis yang
diduduki oleh plaintif pada masa yang berkenaan adalah salah, tidak sah dan
tidak dibuat mengikut suatu kuasa undang-undang. Sungguhpun terdapat peruntukan kl. 4(a) perjanjian
sewaan yang dimasuki di antara plaintif dengan defendan yang membolehkan
defendan mendapatkan pemilikan semula premis tersebut, saya berpendapat ianya
tidak boleh mengatasi peruntukan undang-undang di bawah s. 7(2) SRA 1950 dan
Akta Distres 1951 yang menghendaki suatu tindakan Mahkamah diambil
atau perintah mahkamah diperolehi sebelum pihak defendan mengambil semula
milikannya.”
“Pihak
defendan (landlord) mendakwa di atas kegagalan Plaintif (tenant) mengosongkan premis
tersebut setelah defendan menamatkan perjanjian sewa tersebut plaintif menjadi
seorang penceroboh dan defendan berhak mengusir dan mengambil kembali milikan
harta dan premisnya. Saya berpendapat tiada bayaran sewa dibuat oleh
plaintif bukanlah alas an bagi defendan untuk mengusir plaintif. Ia mungkin
mengurangkan gantirugi.”
“Pihak
defendan juga mendakwa bahawa beliau melaksanakan hak-haknya di bawah kl. 4(a)
perjanjian sewa dan undang-undang common law “self-help” untuk masuk dan
mendapat kembali milikan premis tersebut. Dalam hal ini saya berpendapat
setelah pindaan dibuat kepada peruntukan s.
7(2) SRA 1950 yang berkuatkuasa 31.1.1992 melalui SR (Amendment) Act
1992, remedi “self-help” ini tidak boleh lagi
dipakai.”
5) SME
Aerospace Sdn Bhd [2006] 5 CLJ 121 – the
word “shall” is used in s.7(2) SRA carrying mandatory requirement in obtaining
Court order to recover vacant possession.
Therefore, based on the
above cases, I would conclude that the common law doctrine of self-help is no
longer applicable in Malaysia though it is provided in the
written contract coz technically such provision cant supersedes an existing law.
The effect is - in simple words - to landlord, if u meet a tenant who comes from hell, there is no easy way for you to recover vacant possession, safe to say, the only way that you have is through court action and with the court order. And yes, its time consuming, and a waste of money. But that's my fellow readers, the law in Malaysia.
